What is a Trust?
A Trust is a legal entity where an individual (‘the trustee’) holds assets for the benefit of one or more persons or third parties (called the ‘beneficiaries’). A Family Trust (also known as a Discretionary Trust) is a Trust where the trustee is empowered to decide the benefits the beneficiaries receive from the trust. A Trust can protect family assets and allows for earnings and capital to be shared among family members. Once a family trust is created (by a settlor), usually gifts or loans are made to the Trust by the person who created the Trust.
